Terms of Service
These terms apply to AIOS Cloud (at caligoarts.com/aios) and to AIOS Local (the desktop application), together “AIOS”, provided by Caligo Arts (“we”, “us”). By creating an account, signing in, or using AIOS, you agree to them. If you do not agree, do not use AIOS.
Caligo Arts is a sole proprietorship operated by Kevin Thompson. Questions: CaligoArts@gmail.com. How we handle your data is a separate document: the privacy policy.
The short version. Your notes are yours and we do not train models on them. AI answers can be wrong and you are the one who has to check them. Keep your own backups. AIOS Local runs programs on your computer when you ask it to, and what you ask it to do is your responsibility.
1. What AIOS is
AIOS is a note-taking and productivity tool. Some features use artificial intelligence. AIOS Local can also run programs on your computer at your direction, including creating virtual machines and installing software.
2. Your account
You are responsible for your account and for anything done through it. Keep your password to yourself. Tell us promptly if you believe someone else has access to it. You must be old enough to enter a contract where you live, and at least 13.
We may suspend or close an account that is being used to break these terms, to break the law, or in a way that threatens the service or other people using it.
3. Your content is yours
You own everything you write in AIOS. We claim no ownership of your notes.
You grant us only the permission we need to run the service for you: to store your notes, transmit them between your devices when you switch on sync, and process them so features work. Nothing broader.
We do not use your notes to train AI models, and we do not sell them.
Where AIOS sends text to a third-party AI provider to answer a question, that provider’s own terms apply to that transmission. AIOS shows you what it is about to send before it sends it.
4. Artificial intelligence — read this one
AI OUTPUT CAN BE WRONG, AND YOU ARE RESPONSIBLE FOR CHECKING IT.
AI features produce text by prediction. They can state incorrect things confidently, invent citations, references, figures and quotations, and be out of date. This is a known property of the technology and not a defect we can remove.
Do not rely on AI output for anything consequential without verifying it. In particular, nothing AIOS produces is legal, medical, financial, tax, accounting, engineering, or professional advice of any kind. AIOS is not a substitute for a qualified professional, and features that organise financial information — including receipt scanning and expense exports — are a convenience, not accounting, and are not a substitute for your own records or your accountant’s judgement.
You decide what to do with what AIOS gives you. Those decisions, and their consequences, are yours.
5. Running programs on your computer
AIOS Local can run programs on your machine at your direction — creating and deleting virtual machines, downloading operating system images, installing software, and opening files.
You are responsible for what you ask it to do, for having the right to install and use any software involved, and for complying with the licence terms of that software. Operating systems and other images are downloaded from their publishers under those publishers’ own licences, which are between you and them.
AIOS keeps a log of every command it runs on your machine. Deleting a virtual machine deletes its disk and the data on it, and that cannot be undone from inside AIOS.
6. Backups are your responsibility
Keep your own backups. AIOS Local stores your notes on your computer. AIOS Cloud stores them on our servers and we take reasonable care, but no service is immune to loss, and we do not guarantee that your data will never be lost or corrupted.
We are not liable for lost data. Export or copy anything you cannot afford to lose.
7. Acceptable use
Do not use AIOS to break the law, to infringe anyone’s rights, to store or distribute malicious software, to attempt to gain unauthorised access to any system, to interfere with the service, or to generate content that is illegal.
Do not resell or redistribute AIOS itself without our written permission.
8. Paid plans
Where a paid plan exists, prices and what each plan includes are as shown at the time you buy. Payment is handled by a third-party payment processor; we do not receive or store your card details.
Unless the law where you live says otherwise, fees already paid are not refundable, and you can cancel at any time — cancellation stops future charges and does not refund the current period. We may change prices with notice; a change applies from your next billing period.
9. Availability
AIOS is provided as it is. We do not promise it will be available without interruption, that it will be free of errors, or that any particular feature will continue to exist. We may change, suspend or discontinue features, including free ones.
If we discontinue AIOS Cloud, we will make reasonable effort to give you notice and a way to export your notes.
10. No warranty
AIOS IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that AIOS will meet your requirements, that its output will be accurate or reliable, or that defects will be corrected.
Some places do not allow the exclusion of implied warranties. Where that is so, the exclusions above apply to the fullest extent permitted, and you may have rights that these terms cannot remove.
11. Limitation of liability
To the fullest extent permitted by law:
We are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, goodwill, data, or anticipated savings — however caused, and whether or not we were told such loss was possible.
Our total liability to you for all claims relating to AIOS is limited to the greater of (a) the amount you paid us for AIOS in the twelve months before the claim arose, or (b) fifty US dollars.
This includes, without limitation, liability arising from: reliance on AI output; loss or corruption of notes or other data; anything done by AIOS on your computer at your direction, including the creation, modification or deletion of virtual machines, files or software; interruption of the service; and any third-party software or service reached through AIOS.
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud.
12. Indemnity
You agree to indemnify us against claims, losses and reasonable legal costs arising from your use of AIOS, from content you put into it, or from your breach of these terms.
13. Third parties
AIOS links to and can use third-party services — AI providers, weather and news sources, software publishers, payment processors. We do not control them and we are not responsible for them or for their content. Their terms and privacy policies apply to your use of them.
14. Changes to these terms
We may update these terms. If a change is material we will give reasonable notice, in the application or by email. Continuing to use AIOS after a change takes effect means you accept the updated terms. Each version is dated, and the version you accepted is recorded.
15. Ending it
You can stop using AIOS at any time and delete your account from within it. Deleting your account deletes your notes from our servers; notes stored on your own computer by AIOS Local remain yours and are not affected.
Sections 3, 4, 6, 10, 11, 12 and 16 survive the end of these terms.
16. Law
These terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-law rules. The courts of Tennessee have jurisdiction, except that either of us may seek an injunction anywhere it is needed to protect intellectual property.
If any part of these terms is found unenforceable, the rest stays in force.
